State-wide the measure passed with 63% voting yes. The measure was approved by voters in every one of Michigan's 83 counties. The measure also required Michigan's health department to create a registry of qualified patients. Growing cannabis was also approved, for registered individuals using secure facilities. The mandate also introduced a medical necessity defense clause for persons without a card or who use cannabis to treat ailments not covered by the law. Despite the law calling for cards to be issued within 20 days, the typical wait is 6 months."
In February 8, 2013, the Michigan Supreme Court ruled that dispensaries are illegal and medical marijuana patients will have to grow their own marijuana or get it from a caregiver. Caregivers must be designated and are limited to provide care-giving services to just five patients.
Also, HB 4856 provides a change in the law for patients and caregivers to be aware of is that they will now need to keep marijuana in a container in the trunk whenever transporting marijuana by vehicle. If the vehicle has no trunk, it must be inaccessible to the passengers.
HB 4834 contains for patients and caregivers that they will now only need to renew their registry card every other year.
State Rep. Jeff Irwin introduced HB 4623 , a bill that would decriminalize possession of an ounce or less of marijuana in Michigan. HB 4623 would amend state law and remove all criminal penalties including jail time.
