1. He’s a trespasser. They have limited rights when it comes to personal injury. I think Cali is a lot more liberal than most states when it comes to the duty owed to individuals, as far as the business is concerned.
2. The retailer worker, could argued to be acting outside of the scope of her employment. That’s not a biggie, he could still get by on a negligent hiring/supervision argument.
It’s not impossible, but a claim against a business for the criminal acts of it’s employees against trespassers are a lot more difficult than people would believe.
