CHICAGO — The police detective who shot into a crowd while off-duty and killed teenager Rekia Boyd in 2012 has resigned, saving his pension as well as the indignity of getting fired.

Dante Servin's resignation Tuesday came two days before an "evidentiary hearing" before the Chicago Police Board, said Max Caproni, the police board's executive director. Any charges against Servin, a 24-year police veteran, will now be dropped.

Servin's resignation comes about a year after he was acquitted of all charges related to the death of Boyd, a 22-year-old woman who was with a group of near Douglas Park when Servin pulled a gun while off-duty and shot into the crowd, striking Boyd in the head. Activists have since called for his firing.

By resigning, Servin is now eligible to collect his pension and any other outstanding benefits he stood to lose if fired, angering the activists who called for his ouster.

"The best union to be in in this country is the [Fraternal Order of Police] because you can get away with murder and still get paid," community activist and anti-violence organizer Father Michael Pfleger said.

Martinez Sutton, Boyd's brother, said he found out about Servin quitting Tuesday morning and wasn't at all surprised. He said he figured the process would drag on until Servin walked away with his pension.

After four years of fighting for "justice" for his sister, Sutton said he wasn't sure what "justice" was anymore.

"It destroyed a family. Rekia was light," he said. "I don't know how it affects [Servin], but he has to live with that. He has to live with it on his conscience."

Activists rallied last month to demand Servin's firing for the shooting.

Servin was found not guilty on manslaughter charges in Boyd's shooting death just over a year ago. A judge's ruling suggested he should have been charged with murder instead, which was "unusual" according to legal experts.

Servin's continued employment drew infuriated protesters and figured in Alvarez's defeat in the March primary. Former top cop McCarthy last year recommended to the Police Board that Servin be fired.

Servin "should’ve been fired and instead he can resign and make money and that’s an insult," Pfleger said. Trina Reynolds-Tyler of Black Youth Project 100, an activist group that called for Servin's ouster, said his resignation is "disrespectful."

"He just took an early retirement," Reynolds-Tyler said. "It’s ridiculous that this process has taken so long to get to a firing hearing."

Page May, another local activist, said "it ain't over" till Servin loses his pension. Max Caproni and police union spokesman Dean Angelo did not immediately return messages seeking comment.

Thanks for sharing the story.

Servin was feeling that heat on the back of his neck. He knew he was in real danger of getting fired so he chose the most expedient option.

It is not the victory everyone was hoping for, but there are positives. He's no longer a cop in Chicago - which shows how effective the activism has been. Consider though, the fact that if such a strong activist community was not active, he still would be working, CPD would still be holding onto the dash cam videos of LaQuan McDonald and Ronnieman Johnson - the same police chief, head of IPRA and corrupt chief of Detectives would still have their jobs and there would be no public knowledge of the Homan Square torture site nor reparations for survivors of Jon Burge (South Side police commander who coerced confessions from innocent Black men and boys through the use of torture).

There will be no cataclysmic change where suddenly the whole system will be set right in the blink of an eye. It's going to be gradual - brick by brick.

The Movement Will not be stopped.

Her family needs to get some paramilitary training and handle their business. Now way that motherfucker ain't dealt with

They make sure these race soldiers can still make a living after killing black folks. Meanwhile they dam near bankrupt black celebrities/athletes for dog fighting and calling somebody a faggot. I'm glad the Black Youth Project was relentless in their fight for justice for Rekia Boyd.

Big up to Black Youth Project. Also big ups to Black Lives Matter who led the charge and also to Assata's Daughters and other affiliated organizations allied with the above - all of whom have been continuously fighting for justice for Rekia and others innocent victims of deadly and illegal police violence.

Can the family file a civil law suit against this unremorseful piece of shit and get a chunk of his pension?

you are way more positive than I am about this...see the problem is he can go somewhere else and get another job as a police officer in another state at another level. they will take him right in as one of their own.
I have seen a guy retire at the federal level, then go to the state, then retire, then go to the local level like a hero and still stay on the job as a trainer or consultant. see these folks know the game...we just now catching on. for cops, you can retire at 15 years. then go to the state for another 10-20. so him, resigning saves his job and future employment prospects...if he got fired...very few police precincts could or would take the liability of having a cop that was previously fired get into trouble again...

the family of the victim should sue for millions PLUS get about 75 percent of his pension.

how the fuck you make a retarded decision that cost someone a life, and get gotdamn pension..??

Bruh, this is one of the most well written comments I've ever seen on this board.

I would dedicate my life to his remains never being found if Rekia Boyd was my seed.

It's a different perspective. The war is far from won. During this war, you'll be seeing things like cops choosing to resign rather than face investigations or reviews. You'll hear of more Black people being murdered by police during this war.

Those things don't mean we are losing the war, though. I pointed out victories to show what the people united have accomplished. I also pointed them out to say that we can and will accomplish even greater things.

Thing is, on BGOL, many many people have complained about these injustices. Imagine if everyone here who complained actually joined the Movement! The more people - the more community involved, the stronger and the more unstoppable the Movement becomes. It's as simple as going on Facebook and looking up the local Black Lives Matter and finding out about actions being held - then be at those actions and join your presence and your voice.

A few years ago he would have kept his job.
There is still work to be done and you have some places trying to pass laws to prevent video footage from being shown, but more and more departments are trying to get out in front of a story when tragedy strikes. Some are firing or suspending cops or immediately asking for a third party investigation and offering info sooner to keep the public calm. The federal government is trying to apply pressure where they can: http://www.theguardian.com/us-news/2016/may/12/police-shootings-bill-us-house-gwen-moore
(this is just a bill but if we win big in November we may be able to get it passed)

They don't want the optics of a major BLM protest. Also local media outlets are doing a better job of holding the police accountable. Many are finally asking questions instead of publishing police accounts given at the time as facts. The Washington Post has done some of the best reporting on police brutality and extrajudicial killings anywhere, adding legtmacy to our complaints for a public also inclined to automatically believe the police. There is still much work to be done, but I can now definitely see progress today vs 5 years ago.

A very good assessment.
For those who STILL ignore the gains and naively throw shade at the effectiveness of activism by saying things like, "Marching and protesting aren't doing any good!" - they need only look at the history of protest movements in France to see what is very possible.
