Atlanta Falcons quarterback Michael Vick signed a plea deal (PDF) with federal prosecutors on Friday on charges relating to his participation in an illegal dogfighting ring. Those charges carry a maximum penalty of five years in prison. Vick's 2007 season is lost, but does he have any hope of getting out before the 2008 season kicks off?

Yes, if U.S. District Judge Henry E. Hudson sentences him to one year and one day in prison. Under federal sentencing guidelines, Vick's plea agreement calls for a sentence of between 12 and 18 months. If Vick wants the minimum possible prison term, he should ask for a sentence of slightly more than one year. Under Bureau of Prisons regulations, federal prisoners are eligible for an approximately 15 percent reduction of their sentences if they behave themselves—so long as that original sentence is longer than a year. Sentence of one year? Serve one year. Sentence of one year and one day? With good behavior, you'll serve a bit more than 10 months. Odd but true.

If Vick wants to get out of prison by the start of the 2008 season, he should surrender to federal authorities before he gets sentenced. Any time that he serves prior to sentencing will count toward completion of the prison term he'll ultimately receive. The sooner he goes in, the sooner he'll get out. If he wants to get the one year and one day sentence, he should also accept full responsibility for his conduct at the sentencing hearing, as well as express extreme and heartfelt remorse.

If Vick adopts this game plan, he would just need to avoid fights (dog or otherwise) while in prison. He could be out in 10-plus months—in other words, by mid-July 2008, just in time for next year's training camp.

One additional item in the plea agreement could help Vick get free before next season. Not only did Vick plead guilty, but he also agreed to cooperate with federal authorities. If Vick provides substantial assistance to the feds in the investigation or prosecution of another person who has committed a crime (such as other people involved in dogfighting), prosecutors could ask Judge Hudson to impose a sentence shorter than the 12 to 18 months called for by his plea deal.

Of course, Vick will still have to contend with the NFL, which suspended him indefinitely on Friday. In a letter to Vick, Commissioner Roger Goodell emphasized the quarterback's involvement in illegal gambling. The league prohibits its players from any form of gambling activity; the possible penalties for such behavior include a life suspension. Goodell added that he would "review the status of [Vick's] suspension following the conclusion of the legal proceedings." The NFL could refuse to lift the suspension even after Vick is released from prison. That would put the 2008 season—as well as his whole career—in jeopardy, regardless of whether he manages to snag a one year, one day sentence.

I Wish He Could. But I'm Not Sure We Will Have To See Nobody Should Jump To Conclusion Before The Final Decision Is Made.
 
If vick was smart he would form his own league and be player coach next season. He would take this year to plan his counter league and he would enlist reputable former players like emmit smith, curtis martin jerry rice, jim brown to be team owners. Vick would play next season but instead of playing the high paid slave roll he could pay himself.

The whole legal analysis in the article above was that if Vick surrendered early, the time served prior to sentencing would count towards time served AND see if he could get a year and a day which, counting good time, could put him on the streets within 10 months of his surrender date. Hence, "The Final Decision" might be partially in Vick's hands. Of course, if he has some juicy details of other operations to give to the Feds, . . .

Git real Tem. Vick is in NO position, mentally, financially or freedomly to plan anything, especially a new football league, even this ->ll<- close to the NFL; and, until his current situation is resolved, no one is going to invest big bucks in Michael Vick.

But I think he could be back next season mainly because he has NFL expierence and most that make it to his level are in that very exclusive club. The only thing that would get in his way are those faggot ass, bitch ass men that believe their little FeFe toy dog might not approve.

Vick is in the perfect position to form a counter league why the hell would he want to rejoin the NFL. He is unemployed has plenty of free time and he is extra famous. Like I said if he enlisted the help of emmit smith, curtis martin, tiki barber, jerry rice just to name a few he would have all the capital and reputation he would need to give the league validaty.

As an entrepenuer I see the NFL as a monoply with no competitor which means it is inherently ineffecient in providing it's service (entertainment) to the public. Vick and a few partners could start a league that could rival the NFL in 5 years. Vick playing again next year would be all the publicity they need. Love it or hate it the people would watch just to see Vick play and destroy inferior talent.

And no one needs to invest in Michael Vick black atheletes need to invest in themselves and the future of the next generation of black athelets by providing a choice for atheletically talented black men. The choice is simple work for someone else or work for yourself. A player owned league is bigger then Vick but the Vick situations illustrates why it is so necessary.

I couldn't agree more....

I said this on a high school basketball forum, in regards to another league forming to compete with the NBA, and thought that the whole streetball (And1) concept could give the NBA a wake-up call in terms of just who creates the quality of the league....

Arena football is trying to do that job but has the misfortune of being viewed as a novelty NFL....
 
The fans will decide, if there's empty seats and low TV ratings for ATL games the NFL will let him come back if the Falcons have a decent record and fans turnout for them Vick is thru. If I had to bet I would say he'll be back next year.
