I am trying to expunge a Nolle Prosequi from 2005. Nothing serious, Misdemeanor obstruction of justice. I want it off my arrest record. I don't want to pay a thousand for some simple paper work I can find at a law library. Btw this is in Virginia. Any help would be appreciated.

licensed in ct would not be able to tell you how to do that....btw a nolle prosequi means the state did not prosecute the case...what problems is it causing you.

Thats true so it depends on what type of employment he is seeking..

As some also only go back 10 years but some financial institutions go back all the way.

Do What Ever The State Requires But .............

To Make Sure It Completely Removed ,
Make Sure You Follow Up With The Fbi
In Order To Be Absolutely Positive It Is Off.

I Lost A Major Contract Due To An Error On The Part Of A State
Not Filing The Expungment Properly Or Somebody Just Didnt Do Their Job
And The Shit Came Up.

IT WAS AN ARREST WITHOUT CONVICTION.

Some Background Checks Go Way Beyond State And Local Files.
Make Sure They Send You
The Fingerprint Files Back As Well.

I wish you the best with that. BUT, I had the same thing in Ohio; a " No Bill" arrest, that i had expunged :smh:, and thought was off my record. 17 years later, that shit still pops up to haunt me . Don't waste your money, expungments are scam jobs by lawyers, and courts. Once you get arrested, your info goes to the F.B.I. criminal data base, and once you hit that :itsawrap: That arrest will never go away :smh:

DONT SPREAD BULLSHIT DUDE.:hmm:

Gentlemen thank you for all of your input. I know this is a tedious process and after hearing some of the responses, I might pay for the shit. However, I am going to do some more research. Please more input if possible, the law intrigues me.

expunge means it is erased from your file....

I had a similar experience True...In 1986 i got pinched on some felony drug stuff.

I had a suspended sentence and after completion of the period of time a motion for new trial was filed...It was granted and the result was the conviction was set aside and indictment was dismissed..The court clerk never sent that to the Department of Public Safety who in turn updates the FBI database.

I had fingerprint checks done for employment and that came back clear and with the court order i thought I was straight..They went back 10 years..

fast forward,I was working as a consultant for a bank for almost 4 years in different capacities and they wanted to hire me.They took fingerprints and sent me in for a background check after they offered the job.The new job would have been a pay increase of 20k per year.

Well the conviction came back from 23 years ago and they withdrew the offer and told me since I had the conviction I could also not continue as a consultant.

All because the clerk never sent the court order forward I lost the job I had and the job that was offered.

My expungement hearing is actually 4/6 and I am not sure if they will even do it...Since the conviction was set aside and the original indictment was dismissed I am hopeful but that won't get me my job back or the other position....
