A 22-year-old Joliet man was sentenced today to 3 years in prison for using a cell phone belonging to his underage girlfriend's father to snap a picture of himself inappropriately touching her.

Will County Circuit Judge Amy Bertani-Tomczak handed down the sentence for Steven S. Bodemuller, who pleaded guilty last October to one count of possession of child pornography, State's Atty. James Glasgow said in a news release.

Bodemuller, of the 300 block of North Larkin Avenue, Joliet, admitted that in April 2006, he used a cell phone to take a picture of him "inappropriately touching" his partially clothed teenage girlfriend, Glasgow said.

The phone belonged to the girl's father, who discovered the photo while looking through images on the device and reported it to Joliet police. Charges were filed in July 2006, Glasgow said.

The defendant, who was 21 at the time the picture was taken, told police the image was for his and his girlfriend's private enjoyment. Glasgow said the fact that the two were in a relationship had no bearing on the prosecution of the case.

"It doesn't matter whether the relationship was approved by the girl's parents or whether she consented to appear in the picture," Glasgow said. "Whether the victim realizes it or not, she was exploited by this man. It is illegal to possess a picture of someone under 18 engaged in an act of sexual penetration."

Glasgow said his "heart goes out to the father who discovered the explicit photograph of his own daughter."

Possession of child pornography is a Class 3 felony that carries a sentence of 2-5 years in prison upon conviction, according to the release.

Bodemuller also pleaded guilty to a misdemeanor charge of criminal sexual abuse in an unrelated case. That charge alleged he inappropriately touched a 16-year-old girl he was seeing in July 2005, according to the release.

Bodemuller was 20 at the time of that offense. He was sentenced to 1 year of conditional discharge and sentenced to 180 days in jail on the misdemeanor.
