Rockland County Votes​

A lawsuit challenging the 2024 election results in Rockland County, New York, is seeking a full hand recount of the presidential and U.S. Senate ballots. The case, brought by SMART Legislation, a nonpartisan watchdog group, alleges discrepancies in the vote counts, particularly highlighting that former Vice President Kamala Harris received zero votes in some districts despite the Democratic candidate for Senate, Kirsten Gillibrand, receiving a majority of the votes in those areas.2

The lawsuit also claims that more voters have sworn in legal affidavits that they voted for independent U.S. Senate candidate Diane Sare than the Rockland County Board of Elections counted and certified, contradicting the official results.3 For instance, in District 39, nine voters signed sworn statements saying they voted for Sare, but the Board of Elections recorded only five votes.5

Judge Rachel Tanguay of the New York Supreme Court has ruled that the allegations in the lawsuit are serious enough for discovery to proceed, and a hearing has been scheduled for September 22.2 The plaintiffs argue that if the results are incorrect, it is a violation of the constitutional rights of each person who voted in the 2024 Rockland County general election, and they advocate for a full public, transparent hand recount to ensure the accuracy of the results.3

The Rockland County Board of Elections maintains that the claims are baseless and should be dismissed.7 Despite this, the case continues to move forward, and the potential for a hand recount remains a possibility as the court and the public seek to understand the issues contributing to the alleged irregularities in the election results.
