I'm not sure about that? The police can charge you with what they believe the offense(s) (alleged crimes) have been committed.
The District Attorney's Office will then conduct an interview with the arresting officer(s) to ascertain the facts of the case, and then write up the affidavit (complaint) with the alleged charges.

Seems they did not find him guilty of the charges requiring an intentional act...so probably said he recklessly hurt her.... She said she saw some woman sending him a flirty text and she took his pone....he tried to pry it from her fingers, and then twisted her hand and arm and then all of a sudden she felt a 'ka boom' to the noggin.....seems he was just trying to get his phone back.
