The FBI just raided Mar-A-Lago

Slick move on their part but then again they are way smarter than Judge Cannon who never even practice law, just a federalist society smut

I don't think I've seen this level of disrespect against a judge in motion before...

You are right... they are basically telling her "You have an opportunity to step back on some of this"

They are ripping her opinion apart .....

A couple parts had me laughing out loud:

"The Court appeared to recognize that a sufficient showing of need can overcome potential assertions of executive privilege by specifying that the government may continue to review and use the classified records in its classification review and national security risk assessment. D.E. 64 at 22-24. That aspect of the order reflects an implicit determination that no potential assertion of executive privilege by Plaintiff could justify preventing the Executive Branch from conducting that review and assessment of the classified records. But under United States v. Nixon, the same is true of the review and use of the information by the government in an ongoing criminal investigation. And it would be especially unwarranted to prohibit that review and use while authorizing other personnel in the Executive Branch to review and use the same information. There is no meaningful way in which “the protection of the confidentiality of Presidential communications,” United States v. Nixon, 418 U.S. at 705, is served by barring the Executive Branch’s review and use of the classified records for criminal investigative purposes while allowing a range of personnel across the Intelligence Community to review the very same records for other closely related purposes."

"Third, and for reasons independent of the Supreme Court’s holding in United States v. Nixon, any claim of executive privilege by Plaintiff against the Executive Branch would be especially implausible as to classified records. That authority falls upon the incumbent President, not on any former President, because it is the incumbent President who bears the responsibility to protect and defend the national security of the United States. Even if a former President’s invocation of executive privilege could prevent certain records from being disseminated outside the Executive Branch, cf. Thompson, 142 S. Ct. at 680, such an invocation cannot plausibly prevent the Executive Branch itself from accessing classified information, which is by definition controlled by the Executive Branch and critical to national security."

Man The government is fucking ripping this order apart.... They are basically saying what we are saying about this Judge without explicitly saying it.. they are going to the heart of the fact that her ruling doesn't make sense...

"In addition, the injunction against using classified records in the criminal investigation could impede efforts to identify the existence of any additional classified records that are not being properly stored—which itself presents the potential for ongoing risk to national security.
To be sure, the Court did not enjoin the criminal investigation altogether. For example, the government does not understand the Court’s injunction against the government’s review and use of seized materials for criminal investigative purposes to prevent it from questioning witnesses and obtaining evidence about issues such as how classified records in general were moved from the White House, how they were subsequently stored, and what steps Plaintiff and his representatives took in response to the May 11, 2022 grand jury subpoena.
The government also does not understand the Order to bar it from asking witnesses about any recollections they may have of classified records, so long as the government does not use the content of seized classified records to question witnesses (which the Order appears to prohibit).5 Even so, the prohibition on the review and use of the classified records is uniquely harmful here, where the criminal investigation concerns the retention and handling of those very records, with the concomitant national-security concerns raised by that conduct."
"The government also does not understand the Court’s Order to bar DOJ, FBI, and ODNI from briefing Congressional leaders with intelligence oversight responsibilities regarding the classified records that were recovered. The government similarly does not understand the Order to restrict senior DOJ and FBI officials, who have supervisory responsibilities regarding the criminal investigation, from reviewing those records in preparation for such a briefing. "

Side note this is easily my favorite part of this motion and it's on the first page...

"The government respectfully requests that the Court rule on this motion promptly. If the Court does not grant a stay by Thursday, September 15, the government intends to seek relief from the Eleventh Circuit." :eek2: :eek2: :eek2: :eek2: :eek2: :eek2: :eek2: :eek2:

This is a Massive fucking BALLS move.... Who puts that in a motion before a judge...

Rule on this shit or else we are taking this to the Eleventh Circuit for a full stay of your order.

This is them giving her a way out... I bet if she backs down on the things she is preventing…..the DOJ will withdraw their appeal.

The Appeal process will take to long.

This is another reason why I like the timing of the story on trump having nuclear location info.

The judge that gave the DOJ the go ahead to raid Trump house was appointed by Trump

This is some serious shit that i never even considered.

In laymens terms:

A former president is not permitted to take sensitive records because the current president needs them.

Cot damn. Ain't no copies of this shit back where they supposed to be. Trump has the originals and possibly lost them. FOR GOOD.

These docs are so sensitive there are no copies. Not even on a computer somewhere

Naw. I think the work product is still there for them to review. This is about the idea that a former president has greater legal authority than a sitting President, which goes against the “will of the people” concept as well as cutting at the heart of the executive branch’s ability to protect the nation.

Wanna know the power of the President? Wait until a Republican is in office. From Iran Contra until now, muthafuckas will explore the line

Yeah I was about to say. The OPR or OCR could reproduce them since they were the ones who classified it to begin with.

Probably idk
Could be some that there are only 1 copy.
They said they were in a specific place that there's a procedure to access them and that's how they knew he took them

But ain't that like saying you have the source material for a book, make one hard copy of the book, no pdfs, no scans, then one stupid motherfucker walks away with the cot damn book?

yeap…

this is why lawyers are tripping over this special master shit cause it makes no gawd damn sense…

trump and his team are trying to claim that his privilege as a former president allows to claim documents over the power of a current president.

Which is fucking insane!!!

This is why the DoJ keeps bringing up US vs Nixon.. cause Nixon was trying to do something similar…

If the 11th circuit upholds this shit then criminal law goes into complete chaos….

you would basically allow A person the ability to claim a possessory interest in stolen property….. and demand a special master to determine the rights that they have in the item…

i need people to understand that this is the crazy shit that republicans want to happen….both sides
