Sanders' Criminal Justice Plan Would Radically Cut Prison Population

Democratic presidential candidate Bernie Sanders is proposing a criminal justice overhaul that aims to cut the nation’s prison population in half, end mandatory minimum sentencing, ban private prisons and legalize marijuana. He says the current system does not fairly treat people of color, addicts or the mentally ill.

“We have a system that imprisons and destroys the lives of millions of people,” Sanders told The Associated Press before the planned released of his proposal Sunday. “It’s racist in disproportionately affecting the African American and Latino communities, and it’s a system that needs fundamental change.”

Sanders was promoting the plan during a weekend of campaigning in South Carolina, where the majority of the Democratic electorate is African American. The Vermont senator, who won the support of some younger black Democrats during the 2016 primary, has stepped up his references to racial disparities, particularly during stops in the South and urban areas.

As president, Sanders said he would abolish mandatory minimum sentencing and reinstate a federal parole system, end the “three strikes law” and expand the use of alternative sentencing, including community supervision and halfway houses. The goal is to reduce the prison population by one-half.

“A very significant number of people who are behind bars today are dealing with one form or another of illness,” Sanders said. “These should be treated as health issues, not from a criminal perspective.”

According to the National Alliance on Mental Illness , 2 million people with mental illness are booked into jails annually.

Taking aim at what his proposal calls “for-profit prison profiteering,” Sanders would ban private prisons, make prison phone calls and other inmate communications free, and audit prison commissaries for price gouging and fees.

The plan would legalize marijuana and expunge previous marijuana convictions, and end a cash bail system
that Sanders says keeps hundreds of thousands who have not been convicted of a crime languishing in jail because they cannot afford bail.


“Can you believe that, in the year 2019, 400,000 people are in jail awaiting a trial because they are poor?” Sanders said. “That is a moral outrage, it is a legal outrage.”

According to the Prison Policy Initiative , more than 460,000 people are being held in local jails around the country while they await trial, with a median bail amount of $10,000 for felony offenses.

Sanders wants to improve relations between law enforcement agencies and the communities they serve. To do that, he proposes to end federal programs that provide military equipment to local police forces, establish federal standards for the use of body cameras, provide bias training and require that the Justice Department review all officer-involved shootings.

“You have a lot of resentment in minority communities all over this country, who see police forces not as an asset but as an invading force,” Sanders said.

On capital punishment, Sanders’ plan formalizes his call to end the federal death penalty and urges states to eliminate the punishment as well.

“When we talk about violence in society and trying to lower the levels of violence, it is not appropriate that the state itself is part of capital punishment,” Sanders said.

Sanders said that over the long term, his plan will save the public money because of reductions to overall incarceration costs.

“It will cost money but it will pay for itself many, many times over,” Sanders said. “Locking people up is very, very expensive.”

That's not just that jew it's all of them we have to hold them accountable and vote their ass out when they dont fulfill their campaign promises I agree it sounds good but without a majority in the Senate this falls on deaths door.

Bernie Sanders is the longest serving independent in the history of Congress. If he was interested in personal advancement, he would have become a Democrat a long time ago.

His message in 2019 is pretty much the same as it was in 2016, which is pretty much the same as it was in the 1980s. The man has not been an open socialist since the 1970s because he's full of shit and just wants to do what is popular.

All I can say, man, is that you really have to look way past 2016 to understand who Bernie Sanders is. And if you do, I think it will clear up your misunderstanding.

You're correct about the Senate, which will probably be a death knell for the best aspirations of whomever the Democratic nominee is in 2020.

I appreciate how Bernie Sanders has moved the conversation. There is only one candidate for president who has plainly come out for the right of all Americans over the age of 18 to vote. It sounds so simple and so basic but he's the only person standing up for it. And that type of equality, wiping away all of the disenfranchisement of the new Jim Crow, would be an incredible boon to black political power. Nobody else will go there.

Just like in 2016, nobody would go there with Medicare for All 0r debt-free college but those ideas are basically mainstream among Democrats seeking to lead the party today. This is how it starts.

Not only that, how many prisoners lost their jobs because they couldn't get to work while awaiting trial on crimes they didn't commit?

Correction, the DNC fucked up the vote in 2016 and got exposed. People want to vote FOR someone , not AGAINST some shit. Hillary was the "at least she ain't Trump" vote. This time around, I think the party put themselves in such an unlikeable position, everyone seems like a "at least he/she ain't Trump" vote. Shit is sad. I'm not voting with no emotions on the shit. The irony is that the things Sanders is proposing aren't even revolutionary. These are things that will maybe help the richest country in the world get on par with other "first" world nations.

My 90 year old Grandmother likes Bernie Sanders. I asked her if she was surprised to see an old politician with such radical new ideas. She laughed and said "Nothing new about it. That's the same stuff politicians talked about in the 1950's."

Some of y'all need to grow the fuck up. Just because you don't like someone's politics, religion, race, looks etc doesn't mean that you have to find a way to find fault with everything they say.

The United States Criminal Unjustice system has done so much damage to the black family. I don't want another old white man as president but I will always pay attention when ANYONE is able to shed light on injustices against my people in the form of "the law". The more it is talked about, the better chance we have at changing it.

And therein lies the rub. Prison is just the exhaust from the engine.
 
So each and every one of you know the criminal justice system in America is broken. That it has been used for 400 years as a tool of rich to control the many. Faced with the prospect of releasing 50% of the black people incarcerated in this unjust system and we can't support that? Prison is not the steam it is the machine. It's what drives the cycle of poverty. It ingrains a criminal mentality and socialization in those that experience it and couple that with instantaneous structural societal disadvantages and the millions that are in prison and have gone through the system continue to be victimized for the entirety of their lives.

I'm down to get rid of prisons all together. Disband police all together. Privatize and localize it all. Let's stop pretending this system protects us. About 1% of the people in prison need to be there. Everyone else is socialized into prison through our fucked economic and criminal justice system.
