Nah.. not that serious. The first fall was accidental. The pool dunk was just that, a dunk and nothing else.
You don't dunk people in pools who are fully dressed and you don't know if they can swim or not, especially if they are old and just got dropped on the hard pavement..
Look for charges of assault, batter and attempted murder to be thrown by the DA's and the conviction probability will be based off how the jury interprets the video..
And from what I can see maybe they are better off trying to cop a plea for the lesser charges if its offer to them..

I doubt if its her property, but your right she should have not approach them like that, she was better off calling the cops..
BTW where was the parents in all of that? I saw a few kids looking younger than 11, how the fuck are you going to have that many kids unsupervised by a pool and not expect something bad to happen..

I don't know if it will stick, but I will not be surprised if they try to throw it at him, but this may be window dressing because aggravated assault charges can be just as bad if not worse than attempted murder...

If the old chick lies saying she was knocked out he could be hit with both aggravated assault the first part when he drops her, then attempting murder, for dumping an "allegedly" unconscious person in a pool..
Of course the charges may not stick but as I said before aggravated assault charges can be just as bad as attempted murder.

No, only if that crime was foreseeable. It is going to be difficult to argue that a kid would intentionally throw an old white biddy into the pool for a laugh. If the HOA had expereinc d problems with rowdy teenagers or other folks at the pool, then the biddy might have an arguement if that problem was documented and know to the HOA and they did not do anything to prevent it.
In this case, I don't even think that this criminal act was foreseeable because it was so spontaneous and unusual, so the forseeable test may not even come into play.

It's hard for me to even look at it. Because I just think of how that fall could have damaged her and him.

I don't care about what white folks think, but these kids are dead ass wrong and will pay the ultimate price for it. But I want the one recording punished too for encouraging it.

Murder charges deal with intent and the kid's mindset, mens rea. The kid would have had to want to kill her. If she had died; the most he probably would have been charged with would be manslaughter. Since she didn't die and there is no such thing as attempted manslaughter; he won't face those type of charges. However, he might face battery charges.

But all bullshit aside, give me an old white lady client with a video tape of her being assaulted by negroe thugs while walking her dogs and see what happen in front of a jury.
This shit will NEVER make it to a court room. That HOA is about to pay out that insurance cap. That first slip and fall alone is enough for a woman that age to have lifetime lingering injuries..

Hopefully those dogs are ok.
