I'll give this guy a nod on weapon safety and external mechanisms. In the military, it's pounded into you so much. Whenever I was outside of the wire, I never had MY weapon on SAFE. It was a calculated risk that "I" took. When some guys on my team noticed, their reaction was like, "Your weapon's on Fire". I wasn't gonna spend 5 milliseconds on a switch. And we were all REDCON1...round already chambered.

JUST as I had been saying, with regard to the access of the gun by GZ, the prosecution just used a 'dummy' prop to DEMONSTRATE that GZ could NOT have accessed his weapon from the position GZ claimed he was in. Or rather, that the account about the gun shot is ASSAILABLE.

The prosecution is 'bout to round house the defense.


GZ asserts that, being held down and straddled by TM WHILE TM was bashing GZ's head on the concrete AND covering his mouth during the alleged scuffle. And only AFTER he (GZ) believed that TM saw his gun and was reaching for it, decided to beat TM to the gun and shoot TM in the heart . . . his ONLY option for self defense.

Ok boss . . . sure. "I'll buy THAT for a dollar!!!"


Well, there's a few problems with this.

1. GZ's gun was in a conceal view holster, tucked in his pants. . . . FROM THE BACK

2. TM was shot in the heart, which in GZ'S pinned down position, is to GZ's right hand side. . . . . GZ is LEFT HANDED

3. Now, how about that pinned down position. If GZ was sufficiently straddled by TM, such that TM had the leverage to assault GZ and bash his head with both hands, and muffled GZ's mouth . . . HOW is it PHYSICALLY POSSIBLE for GZ to have reached around TM's leg to grab his gun, positioned at his waist ON HIS BACK . . . Take the gun OFF safety and shoot TM in his heart . . . with the barrel a FOOT AWAY???!!! [See Images]

4. PAY CLOSE ATTENTION TO THE KNEE POSITION of the person on top Given these pictures . . . HOW is it possible for GZ to have had the ARM/ELBOW CLEARANCE to shoot TM in the heart with the barrel at a distance from TM's chest.
Forensic witness said that she determined the shot to be close range from 1-4 ft from victim, if I recall correctly.


5. And wouldn't the bullet enter TM at an upward angle?
6. And would there be some bruising or pain caused by the pressure of a gun against your back while being held down and pummeled by an attacker?

The defense just opened itself up REALLY losing with Mark O'Marra's demonstration.

Basically asking the witness "Is it POSSIBLE for GZ to have achieved the 90º shot IF TM was backing away" . . . WAS A HUGE MISSTEP.

Because IF TM was backing away, then there's no need to use LETHAL DEADLY FORCE. And i saw him hesitate for a fraction of a second as he was asking that question. I think he realized what he had done.


It's up for the jury and the prosecution to pick up on it.

But the I think it HILARIOUS that the prosecution just flummoxed the defenses KEY witness argument . . . with a fucking DUMMY. RICH with irony.
