I've been paying child support for 15yrs. My ex has 4 kids. I'm sure she's selling some kids off for tax refund money. Is there a way to find out who has claimed my daughter in the past? Thanx.

There is a way to find out. Go to your local IRS office and let them know what happend. They will ask you to prove you are their father. They will need the kids SSN's. You have rights as a father to know. And when they catch what she is doing not only will she be in trouble, but whom ever has claimed them. :smh:

Yes, you can go to the IRS. I don't know about prove. The IRS might tell you if someone else claimed them, but the IRS will not tell who. By the way, I didn't claim them (at least not this year).

There is nothing you can do. Like the taxman said you can't claim the kids. The IRS doesn't give a fuck who claims the kid just as long as only one person does. It's not illegal for someone else to claim your child as a dependent. It is only tax-fraud if the person claiming the child didn't provide dependent care for the child for the majority of the year in question. The IRS would have to audit that individule to find that out but all it would take is your daughters mother telling the IRS that that person provided dependent care and she did not claim the child and they will be off the hook.

Bottom line is there is really nothing you can do as the non-custodial parent contacting the IRS would be pointless. You could claim the child on your tax-return and then you and the other person who claimed the child would get audited but why put yourself through an audit and tax laibility just to get even. Let the shit go and move on or get custody of your daughter.

*middle fingers OnyxFemme :angry: :lol: I got caught up in that last year, been claiming a womans grandkids for like 3 or 4 years with no problems $$$$$$$$ and then last year the daughter gets herself a boyfriend and decides to let him claim the kids without telling me or the grandmother :angry: . I got a notice from IRS wanting birth certificates, adoption papers, clothes receipts, letters from schools and churches :lol: :lol: everything showing proof that i took care of the kids for the year. Word got back and the grandmother said she would side with me but i like fuckit and just paid the $$$$$$$ back becuz for one i knew she wasn't gonna really go against her daughter and two you know how these young girls do, jut show up at moms house and leave the kids for mom to take care of, so there was nothing saying the grandmother was the custodial parent anway. What makes it so bad was that my company shut down last year and i had 10g's in my 401k that i had to get out and i had to send half of that to the IRS :angry: and then a month ago i got another letter from them saying i still owed them $42 :lol: [/b]

Just called a tax place-the hold time was too long at the IRS...and both of us are right....
They WILL not just tell him who claimed them, hence why I said he will have to prove it. The PROOF is IF he is on the birth certificate, and 2 pieces of ID for him at a local office. THEN if his information is accurate, they will have to investigate it. After the investigation they (the IRS) as authorized by law they have to tell him. And again she (the childrens mother) and whom ever is claiming them will be in trouble.

^^TRUTH^^ Believe me, I know how hard it is to see everyone else
cashing in, getting these fat ass refund checks, while you work hard all year, sacrifice, and pay support but you get none of the love at tax time. This time of year makes for some greedy motherfuckers, if you'll pardon my language. You really see the character of some people at times like this.

Don't buy into it. Someone said living well is the best revenge. I don't know about all that, but I do know it will piss folks off to no end when they realize that the shit they just know is going to bother you or stress you out, doesn't.

If you don't have that type of relationship with mama, and can't work it out, let it go. Console yourself with the knowledge that you only have 3 more years of child support left. ( maybe less, you said you had been paying for 15 years) Beware though, after age 18, the REAL expenses start, but at least you don't have to deal with the mother unless you want to.)

I'm thanking all for the info and advice given. I'm not really looking for revenge but looking to get some weight to persuade my ex to allow me the tax write-off. Just doesn't seem fair for me to pay 6k out in free money, plus school clothes and other gifts etc. only to have someone else claim my child who doesn't give any support.
 
Unless the mom signed Form 8332 for you to claim your daugther you are basically wasting your time bro.

As a non custodial parent *as already posted* you DO NOT get tax credit for paying child support unless mom signed the above mentioned form.

There is no money owed or obligated to you in any way shape or form.

Next, tax documents are considered by the IRS to be extremely confidential information. Whether you can provide proof that you are the father or not doesn't matter unless you had legal right to claim the child which you don't unless mom signed the above mentioned form (see a pattern here?)

At best your efforts would only get mom audited (but probably not because it's not illegal for other people to claim children) and if mom and Suzy Q corroborate their stories you just wasted a monumental amount of time and energy.

So the burden of proof would be on you to substantiate that there is some type of fraud taking place and you don't even know for sure that there has been any act of fraud committed.

I know its a tough battle to fight with child support bruh but there's no wins using this avenue.
 
Go to your Domestic Relations office get it in writing the percentage that you are paying in support. If you are payin more than 50% of the living expenses then you can claim your kids regardless of who has PRIMARY PHYSCIAL CUSTODY. I DONT GIVE A FUCK WHAT NOBODY SAID I JUS DID THE SHIT 2 WEEKS AGO. IT HAS 2 GOOD POINTS 1) YOU GET TO CLAIM YOUR KIDS AN 2) YOU BABY MOMMA WILL BE MAD CAUSE SHE AINT MAKING ENOUGH WHICH WILL MAKE HER WANT TO MAKE MORE MONEY CAUSING YOU DAILY SUPPORT PAYMENTS TO DROP :yes: .

ALSO IF YOU CAN PROVE THAT SHE HAS THE POTENTIAL TO MAKE MORE MONEY IE: Degree, Certificates, alot of bitches got nursing papers use this against them. Then they can enter her income level at a higher rate thus lowering your daily payments

Ok wait...so you been paying support but it WASN'T court ordered? That puts everything in a different light.

Now if you can prove you were covering at least half of the childs living expenses then like Bababooey says you may have valid grounds to claim the child as a dependent.

You will need to holla at an attorney though, especially one that is knowledgable in tax law.
