A newly released video shows the moment a police cruiser smashed into a dirt bike during a chase in Hunts Point, killing the bike’s driver and injuring his passenger.

Eddie Fernandez, 28, was killed August 11. His passenger, Adalberto Gonzalez, 27, was injured and arrested.

Adalberto Gonzalez broke his leg in the Aug. 11 crash and faces charges of recklessness. Gonzalez’s lawyer, Peter Ronai, has filed a civil claim against the city seeking millions in damages.

‘The police officer barrels into them like a scud missile,’ attorney Peter Ronai, who is representing Fernandez’s dirt bike passenger Adalaberto Gonzalez, told NBC. ‘They were dead ducks. They had no chance. Their only crime was riding a dirt bike. They paid with their lives.’


Psychologically, he's ruined. Watching his best friend die was not easy," attorney Peter Ronai told NBC.

He said the video serves as proof that the police officer purposely hit the pair, despite a NYPD directive not to pursue dirt bikers.

The video was released ahead of the bike’s passenger, Adalberto Gonzalez, appearing in court Monday for reckless endangerment charges.



Gonzalez is scheduled to appear in court Monday on charges of reckless endangerment, resisting arrest and reckless driving.

After the crash, Lt. Hamilton Nunez, of the 41st Precinct, told the Daily News that NYPD policy was not to pursue the dirt bikers because it was too dangerous.

Immediately after the crash and before the video’s release, another attorney for Gonzalez was already calling for an investigation and claiming foul play.

“I simply have an issue that riding an unlicensed dirt bike has become a capital offense, punishable by death,” Cesar Gonzalez said in August. “If their policy is not to chase, when did their policy change, that it’s OK to ram? This dirt bike was rammed.”

The video backs up the attorney’s claim. The cruiser appears to be going at a high rate of speed when it slams into the back of the bike at Randall Ave. and Coster St., throwing both men.

"I wasn't harming anybody,” Adalberto Gonzalez, who broke his leg in the crash, told ABC. “My friend should not have died just for having fun.”

The police car shouldn't have been moving so fast, it looked like he was trying to cut them off and knock them off the bike by hitting the front, but instead hit the back, so it does go down as intentional in my book, but if dudes DON'T run from the cops, they are BOTH still alive!

And BTW, dirt bikes are illegal on ANY public streets in NY State PERIOD, but because they are cheap you will always find them in the hood!​

i never understood why kids, teens or grown ass men. first BUY a atv/dirtbike/scooter/gocart (even those 49/50cc ones) and try to drive them on a CITY street, when they KNOW its illegal to drive on the public street.

but then 2nd to RUN from the police.

is the cop wrong? (hell yeah, but it would had never happened if he wouldnt had been on the bike in the first place).

The city will pay more than $250,000 to settle a lawsuit brought by a Bronx man who was injured and who saw his best friend die in the street after a pursuing police cruiser slammed into the dirt bike they were riding, the Daily News has learned.

Adalberto Gonzalez, 28, was ultimately found guilty of reckless driving in connection with the Aug. 11, 2012 incident in Hunts Point because cops saw him riding a second unlicensed dirt bike before the crash.

But his two more serious charges, resisting arrest and reckless endangerment, were dismissed, and his only penalty was an $80 fine.

“I am glad that I can now get on with my life,” Gonzalez said, noting that one of the two officers involved in the crash has since been promoted. “But what upsets me is that these cops have gotten away with it and they won't stop.”

The man killed in the crash was 28-year-old Eddie Fernandez, whose mother has a separate lawsuit against the city pending in Bronx Supreme Court.

An Internal Affairs Bureau investigation cleared officers Edward McClain and Fernando Santos of wrongdoing in May 2013, describing the crash as an accident, according to an NYPD memo obtained by The News.

The city did not admit any wrongdoing in settling Gonzalez’ Manhattan Federal Court suit.

But a Civilian Complaint Review Board investigation in January substantiated allegations of misconduct, finding McClain recklessly hit Gonzalez with his police cruiser twice. It also determined that both cops made false statements about the incident.

Despite the CCRB finding, the cops have yet to be punished, said Jonathan Moore, a lawyer for Gonzalez.

On the contrary, Santos has been promoted to sergeant and McClain is now on Yankee Stadium duty, the lawyer said.

The Bronx district attorney's office reviewed the incident and chose not to prosecute the cops.

Lawyers for the city have told Moore that the IAB has reopened its probe of the incident, and the NYPD said this week the case “remains under investigation.”

But Moore said officers regularly get away with bad behavior.

“This case should serve as a red flag in the department to look at how police are responding to motor bikes they observe,” he said.

Ramming motor bikes with vehicles is against NYPD protocol, but stunning surveillance video shows the cruiser driven by McClain hitting Gonzalez twice — first on his own bike and then with Ferndanez on the pal’s bike.

Peter Ronai, another lawyer for Gonzalez, said the officers all but “issued the death penalty for a minor traffic infraction.”

“There needs to be pressure on the city of New York,” Gonzalez said this week. “Otherwise my best friend died for nothing.”

A spokesman for the city’s Law Department said settling “ was in the best interest of all parties.”

In addition to $250,000 for Gonzalez, the settlement calls for attorney’s fees for his lawyers that could exceed $100,000.

A surveillance video showing an NYPD radio car rear-ending a motorcycle in the Bronx contradicts the cops’ account of how the fatal accident happened, the Daily News has learned.

Internal Affairs Bureau investigators obtained the video shortly after the Oct. 27, 2012, high-speed chase ended in a crash on Walton Ave., leaving the bike’s driver, Ronald Herrera, mortally injured and his passenger, Leonel Cuevas, brain-damaged.

The initial police reports on the incident stated the dirt bike was not being pursued by police. Cops claimed the dirt bike was attempting to overtake the radio car when Herrera lost control and wiped out.

The cops claimed the cruiser’s emergency turret lights were operating during the pursuit through narrow streets in the Tremont section.

Most significant, the cops maintain in sworn statements that the dirt bike suddenly veered, or swerved in front of their cruiser right before the bike was struck from behind.

None of those claims appear to be true.

“It’s appalling and disgraceful that the officers are clearly not telling the truth,” said lawyer Scott Rynecki, who is representing Herrera's family in a lawsuit against the city and the cops.

“They were chasing a guy for a traffic infraction, not a felony, and the video clearly depicts the officers were violating the patrol guide by conducting an unsafe pursuit,” Rynecki added.

Sgt. Robert Fitzsimmons of IAB acknowledged discrepancies in a deposition for the suit, conceding the radio car turret lights were not on, but said he did not view that as a lie or even a big deal.

“It’s not a severe violation of what transpired, it’s not like saying ‘I was never there,’” Fitzsimmons said.

He put the blame squarely on the bikers. “I believe it was a safe pursuit,” he said. “I believe it was a culpability of the dirt bike rider and also the double-parked vehicles.”

Motorcyclist Ronald Herrera died from his injuries after he was rear-ended by an NYPD radio car in 2012.

Officers Sabrina Alicea, who was driving, and Walkiria Velez, got off with slaps on the wrist for failing to notify the radio dispatcher about the chase and not making make proper entries about the chase in their memo books.

The NYPD prohibits ramming a vehicle to stop it. A city Law Department spokesman wouldn’t comment on pending litigation.

Last month, the Civilian Complaint Review Board issued a report revealing that twice as many cops last year were caught lying or giving false statements in official reports.

I'm sorry about the loss of life, but I hate dem mudda fukken dirt bikers. :angry: No Pitty. They'd kill someone (a child ) and be out. They don't have insurance or paperwork for the bikes. Then the parents show up saying they own the bikes and why is my child under arrest :smh:

The smaller dirt bikes are illegal here because they don't have headlights or tail lights and are very rarely registered with the DMV. I've been guilty of riding one on the streets of NYC, never been chased and if I wouldn't I damn sure didn't plan on running :dunno: you take the ticket, and pick your shit up at the impound lot with the title... if it's stolen, then I suppose you have another set of issues on your hands
