It has been less than a week since 11 Oath Keepers were arrested with seditious conspiracy, but the spouse of Justice Clarence Thomas believes that they "have done nothing wrong."

Bulwark's Charlie Sykes pointed to a letter signed by Ginni Thomas along with many other fringe conservatives like the Family Research Council, the chair of the Tea Party Patriots Fund and the president of the Club for Growth. The letter speaks out against Rep. Liz Cheney (R-WY) and Adam Kinzinger (R-IL), who serve on the Jan. 6 committee which bothers Republicans who believe the GOP should be unified in protecting those who participated in a "coup," as three retired U.S. Army generals characterized it.

The actions of Reps. Cheney and Kinzinger on behalf of House Democrats have given supposedly bipartisan justification to an overtly partisan political persecution that brings disrespect to our country's rule of law, legal harassment to private citizens who have done nothing wrong, and which demeans the standing of the House," the letter Thomas signed says.

It adds to questions about Mrs. Thomas that surfaced after the attack at the U.S. Capitol. On Jan. 6, she was supporting the violence as it unfolded on her social media. When screen captures were being circulated, she promptly deleted her Facebook account, as Law and Crime observed at the time.

Mrs. Thomas has a "long history of incendiary rhetoric, particularly online," CNN.com reported in a report about "rankled" former clerks of Judge Thomas.

It prompted progressives to ask the Jan. 6 Committee to call Thomas to answer questions about whether she helped fund any of the operations through her Republican organization Groundswell. Others said that Thomas should be recused from any cases that ultimately involve Jan. 6 as a result.

"Even worse, however, is the fact that no matter how far his wife takes her antics, Justice Thomas will likely not face any real repercussions for it," CNN noted in their expose of Mrs. Thomas. "Under federal law, justices must recuse themselves from cases in which their 'impartiality might reasonably be questioned,' or where their spouse has 'an interest that could be substantially affected by the outcome.' However, such recusals almost never happen on the Supreme Court. The reality is that while Congress can impeach justices for egregious conduct -- a step not taken since 1805 -- there is no real mechanism for enforcing ethical rules against them."

BREAKING: Something is REALLY up with the DC National Guard response to the Capitol on January 6. A thread.



Let's start at the beginning. The DC National Guard is the only national guard that takes its orders directly from the President of the United States. On Jan. 6, 2020, that person was Donald J. Trump. en.wikipedia.org/wiki/District_….

On January 6, 2020, the ACTING Secretary of Defense was Christopher Miller whose Chief of Staff was Kash Patel - both credibly accused of being Trump toadies.



Miller was ordered by Trump on Jan 3 to "protect the demonstrators"; prohibited National Guard from deploying with weapons or armor without his orders; and withdrew immediate response authority from Gen. Walker, commander of DC Guard.

BUT WAIT "Miller, who was in the chain of command and reported directly to [DJT] testified under oath that the [DJT] never contacted him at any time on January 6th, and never, at any


time, issued him any order to deploy the National Guard."

So ... the DC National Guard was deployed without authority of its Commander In Chief.

What should we make of that?

The early reporting was that Pence gave the order. But Pence isn't in the chain of command.

Army Sec confirmed that explanation: ""But as we worked through it, we ultimately made the determination about a half hour later to mobilize the entire DC National Guard. So, this has been incredibly fluid."



SO ... bottom line 1) DC National Guard deployed against Trump's orders; 2) the FBI/DOJ Swat or similar deployed without Trump's orders.

This could have been so much worse.



And what are we to make of Miller? Did he chicken out? Expect the mob to be reinforced? Why not say - I don't have orders - and just refuse to send in the DC Guard?



For those asking - the 25th Amend requires VP at minimum to transmit a written declaration (including others in cabinet?) that the POTUS is unable to discharge his duties. I can't believe that they could have kept that secret.


Some of the side conversations have made this point: it appears that Pence, Pelosi, Miller, SECARMY McCarthy, McConnell, Schumer and Hoyer got together and - in the absence of Trump protecting the Capitol as the CiC - gave the order. That takes some stones.



If Trump ever gets back in power, he will make each of those people pay to the greatest extent he possibly can.



One more: I would not describe this decision by Pence, etc. (assuming that's what happened) as unconstitutional or lawless ... all of these officials had an independent oath to uphold and protect the constitution, and I am sure they believed they were meeting that oath.

As Investigators Close In On Trump, RNC Hugs Him Even Tighter
The Republican National Committee is considering measures to punish two GOP Trump critics as well as the commission that hosted debates Trump did poorly in.

SALT LAKE CITY — As criminal and congressional investigators close in on former President Donald Trump, the party he leads continues to bend to his will with a new rule designed to punish the debate organization in which Trump performed poorly in both of his campaigns and a resolution condemning two of Trump’s most outspoken Republican critics.

At its winter meeting at a plush hotel in the shadow of the snow-capped Wasatch Range, the Republican National Committee is moving forward with a rule that its 2024 presidential nominee must refuse to participate in the autumn debates sponsored by the Commission on Presidential Debates, the nonpartisan group that has organized them for more than three decades.

“It’s a good idea. It’s been a problem for a long time,” said Ohio committee member Jim Dicke.

The move comes after a failed effort by the RNC to force the commission to change its format in a number of ways to be more “fair” to Republicans. It was led by David Bossie, a Trump campaign adviser in both 2016 and 2020 and now an RNC committee member from Maryland.

Bossie, who declined to comment, is also behind a resolution demanding that House GOP leaders expel Reps. Liz Cheney, of Wyoming, and Adam Kinzinger, of Illinois, from the Republican caucus for being insufficiently loyal to Trump. Both are serving on the House committee investigating the Jan. 6, 2021, assault on the Capitol, which Trump incited for weeks with lies that the 2020 election was “stolen” from him through massive fraud.
“We’re requesting that they do their jobs and kick them out,” Louisiana committee member Roger Villere, a resolution co-sponsor, said.

A number of RNC members said the resolution is likely to be watered down, but that some form of it probably has the support to pass the full 168-member group. Members have been grumbling for a while that Cheney’s and Kinzinger’s participation has given the Jan. 6 committee ― which has started to subpoena RNC members and staff in its efforts to document Trump’s scheme to overturn his election loss ― the ability to call itself bipartisan.

“There’s a lot of criticism around here of Cheney and Kinzinger already,” said Nebraska committee member J.L. Spray.

Cheney, who has one of the most conservative voting records of any Republican in Congress, responded with a statement criticizing her party for its continued loyalty to Trump. “The leaders of the Republican Party have made themselves willing hostages to a man who admits he tried to ‘overturn’ a presidential election and suggests he would pardon Jan. 6 defendants, some of whom have been charged with seditious conspiracy. I’m a constitutional conservative and I do not recognize those in my party who have abandoned the Constitution to embrace Donald Trump,” she said. “History will be their judge. I will never stop fighting for our constitutional republic. No matter what.”

The move to change the rules to require the 2024 nominee to boycott debates sponsored by the debate commission, meanwhile, appears to have broad support — even though it could put the GOP nominee at a disadvantage facing an incumbent Democrat seeking reelection.

Utah Sen. Mitt Romney, the GOP nominee in 2012, for example got a major boost in his first debate against President Barack Obama, although his campaign later complained that the moderator for the second debate fact-checked one of his statements in real time.

Romney nonetheless told Business Insider recently that pulling out of the debates “would be nuts” and bad for voters. “The American people want to see candidates for president debating issues of consequence to them, and it provides a service to the country and to the people, to hear the prospective candidates of the two major parties duke it out,” he said.

Trump, who lacks knowledge about a vast array of issues important to the presidency, instead relied on extravagant boasts and personal insults in debates throughout his brief political career. While this approach worked for him in the 2016 GOP primaries where the audience egged on his attacks, it was less effective in the general election debates in both 2016 and 2020. Many observers believed Trump hurt his cause in all five of those encounters, most particularly during his first debate in 2020, in which Trump repeatedly and aggressively interrupted Democratic nominee Joe Biden, until Biden finally retorted: “Will you shut up, man?”

The debate commission said it would consider moving up the first debate in 2024 to before the start of early voting, as the RNC had asked, and would take the RNC’s claims of unfairness under consideration, but that it would not permit the RNC or any other party or group to take part in its board meetings, as the committee had demanded.

After the RNC made its rule-change threat public last month, the commission said it deals with the campaigns of the actual nominees, not political parties. It offered that same response to the RNC’s latest actions, which could result in final approval for its new rule at its summer meeting. “The CPD deals directly with candidates for president and vice president who qualify for participation in the CPD’s general election debates,” the commission said. “The CPD’s plans for 2024 will be based on fairness, neutrality and a firm commitment to help the American public learn about the candidates and the issues.”

Trump, despite losing the election by 7 million votes nationally and 306-232 in the Electoral College, became the first president in more than two centuries of elections to refuse to hand over power peacefully. His incitement of the Jan. 6 assault on the Capitol – his last-ditch attempt to remain in office ― killed five, including one police officer, injured another 140 officers and led to four police suicides.

He is now under investigation by federal and state officials in multiple jurisdictions.

New York State Attorney General Letitia James has been conducting a civil probe of his family business, while the district attorney in Manhattan has been running a criminal investigation.

Meanwhile, the district attorney in Fulton County, Georgia, has impaneled a special grand jury just to focus on Trump’s attempt to coerce state officials to “find” enough votes to overturn his loss of that state to Biden in 2020.

And the House Jan. 6 committee has been subpoenaing more and more former and current Trump aides to determine his precise role in that day’s events, while the Department of Justice last month confirmed that it is investigating at least one element of Trump’s scheme to remain in power: the submission of fake Trump “electors” in states that Biden won.

At a rally Saturday night, Trump asked his followers to stage “the biggest protests we have ever had in Washington, D.C., in New York, in Atlanta and elsewhere” if prosecutors came after him, “because our country and our elections are corrupt.”

Despite this, Trump remains the dominant figure in the Republican Party and is openly speaking about running for the presidency again in 2024.

WASHINGTON — A judge's son who stormed the U.S. Capitol on Jan. 6, 2021, while clad in fur, wearing a stolen police vest and carrying a police shield pleaded guilty Wednesday to three counts during a virtual court hearing.

Aaron Mostofsky, a 35-year-old from Brooklyn, New York, pleaded guilty to one felony count of civil disorder, one count of theft of government property and one count of entering and remaining in a restricted building. U.S. District Judge James E. Boasberg accepted Mostofsky's guilty plea and set a sentencing hearing for May.

Under the terms of a plea deal, federal prosecutors will drop the charge against Mostofsky that subjected him to the longest potential prison sentence: obstruction of an official proceeding. But Mostofsky pleaded guilty to a felony charge that made it unlawful to "obstruct, impede, and interfere with a law enforcement officer" during the commission of a civil disorder, a charge that comes with a maximum penalty of five years in federal prison.

Tasha Adams, the estranged wife of Oath Keepers founder Stewart Rhodes, is providing photographic evidence of the "elaborate escape tunnels" he allegedly constructed in their backyard.

On Wednesday, a federal magistrate judge cited Adams' testimony about the escape tunnels in an order denying Rhodes bond on seditious conspiracy and other charges related to the Capitol insurrection.

A short time later, Adams posted photos corroborating her testimony.

"Folks if you ever feel tempted to rent a backhoe and dig escape tunnels in the backyard of your rental house, keep in mind it may come back to haunt you if you later attempt to overthrow the US government," Adams wrote.

"This isn't even the tunnel system I was talking about," Adams added, clarifying that the photos actually showed a "training hole" that was "less elaborate."

"I might have pics of the real thing somewhere, my daughters used them as a playhouse," she wrote.

Another Twitter user asked Adams about her statement that it was a "rental house," inquiring whether the landlord was also a member of the Oath Keepers.

"(I)f not bet they're pissed," the person wrote.

"Yes. He thought it wasn't a bad idea," Adams responded, referring to the landlord.

In a related twist, Rhodes reportedly claimed in court that at the time of his arrest by the FBI on Jan. 13, he was living with his girlfriend, Kellye SoRelle, who is now serving as acting director of the Oath Keepers.

However, contacted by BuzzFeed News' Ken Bensinger, SoRelle reportedly denied the two are in a relationship.

"She (SoRelle) conjectures that he may have told the court that in a bid to get released to her house," Bensinger reported.

"I think Stewart just wanted to have a place to stay," SoRelle reportedly told Bensinger.
