Houston Man Finds Out He Was Scammed $40 for Parking While on a Date. So, He Left Date, Fatally Shot the Scammer and Then Went Back to Date, Cops Say.

AHouston man has been arrested and charged with murder after he allegedly killed a parking scammer over $40 while he was on a date, according to authorities.

Around 7:30 p.m. on April 11, police said a couple parked separately at a lot in East Downtown Houston. The couple reportedly paid a total of $40 to a man who said he was a parking attendant, KRIV reported.

The couple then headed to Rodeo Goat for their date, but minutes later, court records state Erick Lee Aguirre, 29, was informed by an employee at a nearby business that the attendant, later identified as 46-year-old Elliott Nix, was actually a scammer, according to KRIV.

Aguirre then went to his car, grabbed his gun, shot Nix in the back and then left his body on the sidewalk, authorities said. A witness saw the shooting take place and called police.

Meanwhile, Aguirre made his way back to the restaurant and reportedly told his date he “just scared the guy and everything is fine,” KRIV reported.


However, the couple left the restaurant a few minutes later and continued their date at another location, police said.

Houston police released surveillance footage of Aguirre and the woman, which helped lead to the arrest of Aguirre in Aransas County, Texas, KRIV reported. He was extradited back to Harris County on April 25.

Police said the female person of interest voluntarily spoke with detectives and was released with no charges filed.

Aguirre had his first court appearance on April 27 and was charged with murder and his bond was set at $200,000, officials said.

Prosecutors said Aguirre was out on probation for a 2017 aggravated assault charge in Corpus Christi.

HOUSTON – A man is accused of portraying as a parking lot attendant and up charging drivers in downtown Houston.

Toine Gillespie said the man, identified by Houston police as Elliot Nix, told her Saturday she had to pay $20 to park instead of the regular $7 near Discovery Green.

"We were approached by an attendant, who said it's going to be a special event parking today, because of all the events going on," Gillespie said.

When she heads downtown to dine at her favorite restaurant, Gillespie said she typically parks at the paid parking lot on 1118 Crawford Street. However, this Saturday, she said she couldn't pay for her parking at the machine.

"He had on a vendors tag, so I looked and said let me see your tag because it's unusual," she said. "I come to this restaurant pretty frequently, and the parking is usually just always $7," she said.

Gillespie said she noticed that Nix's vendor tag was expired. She said she hesitated, but handed the money over to the man.

In return, she said Nix handed her a ticket that belonged to the Renaissance Austin Hotel.
Once inside the restaurant, she said she checked with the staff about the parking price increase. The staff informed her there had been no price increase and that she was probably scammed.

She said she left the restaurant immediately, flagged down a patrolling officer, who found the man in the parking lot.

Nix was charged with theft Saturday, officials said.

Gillespie said she is glad she took quick action to find the man pretending to be a parking lot attendant.

“You just have to follow your instincts,” she said. “If someone approaches you and says, ‘Hey, you need to pay me.’ Just be cautious, ask questions.”

I used to think like this until I had fools try to take me out, staging an accident up. Many times people will try to harm you effeminately, it won't be an obvious attack.

I don't know if it is PTSD, but you want to use deadly force immediately and eliminate any threat. A simple incident like this could easily trigger, based on my past experiences. Many people in the military have this hair trigger response after being in combat.



I know Suge Knight got shot up and this incident is no surprise afterwards. When people chase after me and try to play around with their stupid schemes, I want to use deadly force immediately. This might explain why police use unwarranted deadly force at some traffic stop.

A Texas man who was allegedly scammed of $40 in parking fees while on a date shot and killed the man who posed as the lot’s attendant – and then “nonchalantly” walked away to proceed with his dinner plans, court records show.


Erick Aguirre, 29, appeared in court Thursday for a felony murder charge in the killing of 46-year-old Elliot Nix on a Houston street where witnesses saw the shooting unfold, according to court records.


On the evening of April 11, Aguirre paid Nix $40 after the victim claimed he was the parking attendant and said that it would cost $20 to park Aguirre and his date’s cars, according to a Harris County probable cause affidavit.


Before the couple walked into a restaurant, they were informed by a restaurant employee that they had been scammed, the affidavit says.

A witness who saw Aguirre’s initial interaction with Nix told police he then saw the defendant sprint to his car, grab a gun and run after Nix who was out of his view, according to the court documents.

The witness heard a gunshot and then “observed the suspect nonchalantly walking back to his car with the gun in his hand,” according to the affidavit. Another witness who found Nix bleeding in the street called 911.

Aguirre allegedly shot Nix in the torso, and he died later at the hospital from his wounds, according to court records.


After leaving the scene, Aguirre put the gun in his car and walked back to where his date was waiting, then they entered the restaurant, according to the affidavit.

The woman on the date later told police she did not see or know about the shooting at that point, the affidavit states.
Following the shooting, Houston Police released a surveillance photo showing Aguirre and his date together, asking for the public’s help with identification. The woman in the photo contacted police and voluntarily testified against Aguirre, police said.


When Aguirre came back to her after chasing after Nix, he told her “he just scared the guy and everything was fine,” she told investigators.

That's the biggest problem in our community right now is cold blooded killers on a loose and we know who the fuck they are and people like you don't tell on them because of why? Nationwide we got people who are free to do more crime and more murders and we know who the fuck they are but nobody says anything because of their relation to the suspect.

I am not for black people being in jail, but I am for cold-blooded murderers to be in jail for the rest of their life. They can't play well with others
