SANTA CLARA, Calif. -- San Francisco 49ers linebacker Reuben Foster's former girlfriend released a statement Wednesday saying she initially lied to police about him injuring her in a February incident at his home in Los Gatos, California.

The statement from San Jose attorney Stephanie Rickard, who identified her client in the statement as 28-year-old Elissa Ennis, said Ennis suffered her injuries as the result of a fight with another woman and there is video documentation of that fight.

"[Foster] did not strike her, injure her or threaten her," Rickard said.

According to the statement, Foster attempted to end their relationship after learning of the fight between Ennis and another woman.

"She was extremely upset and told him if he broke up with her, she would 'trash his career,'" Rickard said.

Rickard said that when Ennis realized what she had done, she attempted to go back to the Santa Clara County District Attorney's Office in an effort to recant her original statements blaming Foster for her injuries.

The district attorney's office filed charges against Foster on April 12 for domestic violence with an allegation that he inflicted great bodily injury, forcefully attempting to prevent a victim from reporting a crime and possessing an assault weapon, all of which are classified as felonies.

In the D.A.'s initial accounting of the events of Feb. 11, Ennis flagged down a passing car outside the Los Gatos home after he dragged her by her hair, punched her in the head eight to 10 times and physically removed her from the house.

Ennis' injuries included a ruptured ear drum, which required a visit to the hospital. After her attempts to recant her initial statements, the district attorney's office suspected that it was possible she would not cooperate with their case but told reporters at Foster's arraignment that the case against Foster would be pursued even without her help.

In the days after the charges against Foster were filed, the 49ers and Foster came to an agreement that he would refrain from participating in team activities until the legal process played out.

Earlier this week, 49ers general manager John Lynch again indicated the desire to see Foster's case come to a conclusion before making any decisions about his future with the team.

"I'm not at liberty to go in depth on this because it's an ongoing legal process, and we're going to respect that," Lynch told reporters. "I do have a couple of thoughts. Speaking for [CEO] Jed [York] and [coach] Kyle [Shanahan] and speaking for the York family, as you all know and as our release indicated, we take the gravity of these charges extremely seriously. We do feel like patience is the right approach right now. We're going to learn things through this legal process.

"But I want to be abundantly clear: If these charges are proven true, if Reuben did hit this young lady, he won't be a part of this organization going forward."


Foster has remained in contact with the 49ers and has been working out on his own. He is scheduled for another court appearance on Monday, and he still has a May 2 hearing in Tuscaloosa, Alabama, related to a Jan. 12 arrest for second-degree marijuana possession.

The NFL has been monitoring both cases, and either could lead to discipline from the league, up to and including suspension. Both cases will be reviewed under the league's policies on substance abuse and personal conduct.

The statement from Rickard ends with an acknowledgement from the woman of the attention Foster's case has drawn and how it is being perceived in the midst of the #MeToo movement.

"This case isn't one of those," the statement reads. "[She] apologizes to everyone that may have been harmed in this case, especially Mr. Foster."

San Francisco 49ers linebacker Reuben Foster was arrested Saturday night at the team hotel in Tampa, Florida, on charges of domestic violence.

An arrest report from the Hillsborough County Sheriff's office said Foster was booked into jail at 11:11 p.m. He is being held without bail.

Foster was arrested by Tampa police at 9:10 p.m. at the Grand Hyatt hotel where the team is staying before playing the Tampa Bay Buccaneers on Sunday.

The 49ers didn't immediately respond to request for comment. But general manager John Lynch and coach Kyle Shanahan said in April following a previous arrest for Foster on domestic violence charges that were eventually dropped that the team had a zero-tolerance policy on the issue.

"We can promise you guys, if there's someone who ever hits their significant other, girlfriends, some person like that, that person is not going to be on our team,'' Shanahan said. "I feel strongly about that. I know John does. I know our ownership does. That's how we feel about it. Obviously, Reuben is on our team right now, so we're waiting to see how that goes. But, if that's something that we felt he did or ended up happening, you guys will see how we feel.''

Foster has had multiple run-ins with the law since being drafted by the 49ers 31st overall in 2017.

Foster was charged in January in Alabama with second-degree marijuana possession. That charge was eventually dismissed after he completed a first-time offender diversion course.

Foster then faced more serious charges for an incident at his home in Los Gatos, California, in February. He was initially charged in April with felonies for domestic violence, making criminal threats and weapons possession after being accused of beating up his ex-girlfriend.

A judge ruled there was no probable cause on the first two charges after the ex-girlfriend recanted the allegations and the judge found no other evidence to support the charges. The weapons charge was reduced to a misdemeanor and Foster pleaded no contest to that in June.

He was sentenced to two years' probation, 232 hours of community service, and $235 in fines. He will not be allowed to own guns while he's on probation.

After the charges were dropped, Lynch said Foster was told he would have to continue to earn his place on the team with his behavior.

Foster was suspended the first two games of the season for violating the NFL's conduct and substance-abuse policies.

Foster has struggled on the field this season as he has dealt with shoulder and hamstring injuries. He had missed the past two games because of a hamstring injury and is listed as questionable for Sunday.

Foster has 29 tackles in six games this season with no sacks, forced fumbles, fumble recoveries or interceptions. He has also missed 10 tackles in six games, according to SportRadar, and has the second highest rate of missed tackles among any linebacker with at least 200 snaps on defense.

In a dramatic takedown of the Santa Clara County District Attorney’s case, Judge Nona Klippen ordered the two felony domestic violence charges against 49ers linebacker Reuben Foster to be dismissed, and the third charge — one for illegal weapons possession — to be downgraded to a misdemeanor.

“No evidence” was Klippen’s go-to phrase Wednesday. She repeated it several times while reading her scalding 24-minute decision, which came after testimony during a preliminary hearing last Thursday.

The prosecution, Klippen said, didn’t meet the preliminary hearing’s low bar of establishing “probable cause” that Foster was guilty of domestic violence charges. Because of that, Klippen said, Foster should not stand trial for them.

So now Foster, who has been on an agreed-upon leave of absence from the 49ers during these legal proceedings, will rejoin his team Thursday. Over the past month, general manager John...

Reuben Foster’s second domestic violence charge has been dropped. TMZ Sports reports that the State attorney’s office in Florida has dropped the charge against the former San Francisco 49ers linebacker. According to TMZ Sports, Foster was scheduled to appear in a hearing on Thursday, but that hearing was cancelled after the notice of termination of prosecution was filed.

According to Reuben Foster’s lawyer (per TMZ) the second charge was dropped due to the witness’ (identified as the victim) credibility. The victim in this incident, Reuben Foster’s on/off girlfriend was identified as the same from Reuben Foster’ first domestic violence incident. In the first incident, she recanted her allegations on the stand. She later admitted (after the second domestic violence incident) she lied about that very recanting.

The second charge revolves around a November 24 incident at the 49ers’ hotel room the night before the 49ers played the Tampa Bay Buccaneers. The 49ers released Foster the following morning.

Foster was claimed off waivers by Washington, who stated they were going to let the legal process play out and that Foster would not suit up until his legal issues concluded. The NFL in turn, placed Foster on the commissioner's exempt list, further preventing him from playing.

While this legal issue is resolved, Foster could still face discipline from the NFL for the 2019 season.

Prosecutors in Florida dismissed a misdemeanor domestic violence battery charge against Washington Redskins linebacker Reuben Foster stemming from an alleged altercation he had with his former girlfriend in a Tampa hotel in November.

Andrew H. Warren, the Florida State Attorney for Hillsborough County, stated the charge was dropped Wednesday following his office's review of the criminal report affidavit detailing the incident, per court records obtained by NFL.com.

TMZ first reported the development.

Foster's Nov. 24 arrest in Tampa led to the linebacker being released by the San Francisco 49ers hours before their Week 12 game against the Buccaneers. He was claimed off waivers by the Redskins three days later and placed on the Reserve/Commissioner Exempt List by the NFL -- a move that prevents the linebacker from playing until the league's investigation into Foster has been completed.

Under the league's personal conduct policy, players can be disciplined by the NFL even if they are not charged or convicted of a crime.

"We are monitoring all developments in the matter, which continues to be under review by the league," NFL spokesman Brian McCarthy said in a statement.

Elissa Ennis, the alleged victim, told police that during a verbal altercation with Foster, he slapped her phone out of her hand, pushed her in the chest area and slapped her with an open hand on the right side of her face. Officers observed a one-inch scratch on her left collarbone, according to police.

During their initial investigation of the incident, officers learned Foster and the victim lived together in the past and they were involved in an on-again-off-again relationship over the past three years.

Foster has had multiple run-ins with the law since being drafted by the 49ers 31st overall in 2017. He was charged in January in Alabama with second-degree marijuana possession. That charge was eventually dismissed after he completed a first-time offender diversion course.

He then faced more serious charges for an incident in California in February. He was initially charged in April with felonies for domestic violence, making criminal threats and weapons possession after being accused of assaulting Ennis.

A judge ruled there was no probable cause on the first two charges after Ennis recanted the allegations and the judge found no other evidence to support the charges. However, Ennis said during an interview in December she lied in court in order to protect Foster's career.

While Foster might no longer be in legal trouble in Florida, his NFL career remains in limbo. Shortly after the Redskins claimed him off waivers, Redskins coach Jay Gruden said he didn't know if Foster would ever play for the team.

"There's no guarantee he's ever going to play here," Gruden said. "He's got a lot of work to do -- personally, with the team, with the NFL, with himself -- before he even thinks about playing football again."

Dude got out a couple of months ago and posted a live video of him at the club dancing behind a woman, when he moved the camera to show the woman guess who the woman was, IT WAS HER!!!!


For some women, its easier to go back to / be with the evil you know than goimg oit to the world and risking being involved with a whole new evil....

Some women remain in relationships because of fear and threats, in this case, this guy was locked up and she could have gotten away from him. No excuse for getting back with this guy as far as I'm concerned, think of the trauma to your parents and kids with getting back with him.

The threats come after they have left the guy and came back 2 or 3 times, that’s why they say it only gets worse. Instead of the dude saying to himself well maybe if I stop beating her she’ll stay, he’s like i’m gonna beat her even more and threaten her and her family members so she’ll be scared to leave again
